SB277 “Grandfather Clause” PBE
Personal belief exemptions filed before January 1, 2020 are transferable to all public and private daycare, preschool and K-12 schools within the state. They are valid until the next grade span "checkpoint" of TK/K or 7th grade. It doesn't matter which grades are included in the school. The "checkpoints" are limited to the specific grade. Inclusive is defined to include all grades within the grade span.

SEC. 2. Section 120335 of the Health and Safety Code is amended to read:
(11) (g) (1) A pupil who, prior to January 1, 2020, submitted a letter or affidavit on file at a private or public elementary or secondary school, child day care center, day nursery, nursery school, family day care home, or development center stating beliefs opposed to immunization shall be allowed enrollment to any private or public elementary or secondary school, child day care center, day nursery, nursery school, family day care home, or development center within the state until the pupil enrolls in the next grade span.
(2) For purposes of this subdivision, “grade span” means each of the following:
(A) Birth to preschool.
(B) Kindergarten and grades 1 to 6, inclusive, including transitional kindergarten.
(C) Grades 7 to 12, inclusive.
Doctors are not required to sign a valid PBE
When Governor Brown signed AB2109 into law he directed the CDPH to make provisions for parents to exercise their right to a religious exemption without the additional signature of a medical professional. See Section B of CDPH form 8262. It clearly states that parents can file a religious exemption using the form or by submitting a letter of affidavit, without any additional signatures.
Prior to AB2109 the only signature required for all PBEs in California was the parent or legal guardian. The PBE form is typically referred to as a “Blue or Yellow Card”. These valid grandfathered PBEs must be honored!
